1. Acceptance of Terms
By creating an account, signing in, or using the ABC Amplified platform, you agree to these Terms of Service. If you do not agree, do not use the service.
2. Description of Service
ABC Amplified provides a software platform used by real estate brokerages and their agents to manage leads, transactions, communications, and related workflows.
3. Account Registration and Eligibility
You must be 18 or older and provide accurate registration information. You are responsible for safeguarding your password and for all activity under your account.
4. SMS Communications
By providing your mobile phone number and opting in (via account signup checkbox, agent-initiated invitation reply, or other consent mechanism described in our Privacy Policy), you authorize ABC Amplified and the Brokerage Tenant under which your account is provisioned (e.g., Castle Realty) to send you transactional SMS messages including two-factor authentication codes, appointment confirmations and reminders, lead-to-agent assignment notifications, contract status updates, and closing-day reminders.
Message frequency varies based on your account activity. Message and data rates may apply. Reply STOP at any time to opt out. Reply HELP for assistance.
We do not share, sell, or disclose your mobile phone number or SMS consent records with any third party for marketing purposes.
5. Acceptable Use
You agree not to misuse the platform, including: accessing accounts you don’t own, scraping data, transmitting malicious code, or using the service in violation of applicable law.
6. Intellectual Property
The platform, including all software, content, and trademarks, is owned by ABC Amplified, LLC or its licensors. You receive a limited, revocable license to use the platform as intended.
7. Brokerage Tenant Relationships
ABC Amplified is a software-as-a-service platform. Real estate services, advice, and representation are provided by the Brokerage Tenant under which your account is provisioned, not by ABC Amplified directly.
8. Disclaimers
The platform is provided “as is” without warranties of any kind. ABC Amplified does not warrant that the service will be uninterrupted or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, ABC Amplified’s liability is limited to the amount paid by you (if any) for the service in the 12 months preceding the claim.
10. Termination
Either party may terminate your account access at any time. Surviving sections (Intellectual Property, Disclaimers, Limitation of Liability) remain in effect after termination.
11. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.
12. Changes to Terms
We may update these Terms at any time. Material changes will be announced via in-product notification.
